## What is the penalty for filing a 1099 late?

For forms due in 2027 the 1099 late filing penalty is $60 per form filed within 30 days, $130 through August 1, and $340 after that or never, up to a yearly cap. It is charged again when the contractor's copy is late too, and intentional disregard starts at $690 a form with no cap.

The 1099 late filing penalty is charged per form, and the clock that sets it starts on the due date, not on the day someone notices. For 2026 payments that date is Monday, February 1, 2027 for the 1099-NEC. The first time most owners look it up is in March, after the CPA asks for the contractor list and three of the painters, the bookkeeper and the landlord turn out to have no form at all.

This post sets out what that costs, form by form, using the IRS figures for both filing seasons: forms due in 2026 (for 2025 payments) and forms due in 2027 (for 2026 payments). It also covers the second penalty most summaries skip, what counts as late beyond the date, and how relief works when the forms are already late. Ledgerbrook keeps books and does not file returns, so take a specific notice to the CPA or enrolled agent who prepares yours. To run your own numbers, use the [IRS penalty calculator](/tools/irs-penalty-calculator/).

## 1099 late filing penalty for 2026 and 2027

The penalty for a late information return is set by IRC §6721, and its dollar amounts are adjusted for inflation each year. It depends on when the correct form finally reaches the IRS:

| Filed | Forms due in 2026 | Forms due in 2027 |
| --- | --- | --- |
| Within 30 days of the due date | $60 | $60 |
| 31 days late through August 1 | $130 | $130 |
| After August 1, or not filed | $340 | $340 |
| Intentional disregard | $680 minimum | $690 minimum |

Sources: the IRS [information return penalties](https://www.irs.gov/payments/information-return-penalties) page (read October 30, 2026) for forms due in 2026, and [Rev. Proc. 2025-32](https://www.irs.gov/pub/irs-drop/rp-25-32.pdf), section 3.57, for forms due in 2027. The per-form amounts did not change between the two years; only the yearly caps and the intentional disregard figure rose. One detail in the revenue procedure: its 2027 table labels the middle tier “on or before August 1, 2026”, while the statute measures it from August 1 of the year the form is due (IRC §6721(b)(2)). Read it as August 1, 2027.

For a 1099-NEC due February 1, 2027, the tiers fall like this:

- **$60** if filed by Wednesday, March 3, 2027.
- **$130** if filed from March 4 through August 1, 2027.
- **$340** if filed later than that, or never.

The same table covers W-2s, 1099-MISC, 1099-INT and the rest of the information returns in the IRS general instructions, so a W-2 late filing penalty is figured exactly the same way.

### The yearly caps, and who counts as a small filer

Each tier has a maximum for the calendar year. The lower set applies to a filer whose average annual gross receipts for the 3 most recent tax years were $5,000,000 or less ([General Instructions for Certain Information Returns](https://www.irs.gov/instructions/i1099gi), Part O):

| Tier | Cap, small filer, due 2026 | Cap, small filer, due 2027 | Cap, others, due 2027 |
| --- | --- | --- | --- |
| Within 30 days | $239,000 | $244,500 | $698,500 |
| Through August 1 | $683,000 | $698,500 | $2,095,500 |
| After August 1 | $1,366,000 | $1,397,000 | $4,191,500 |

A business that pays a dozen contractors will never get near these numbers. They matter for payroll companies and platforms filing thousands of forms, and they are listed here because nearly every page that ranks for this question quotes the per-form amounts without saying the caps changed for 2027.

### Intentional disregard

A payer who knew about the requirement and chose not to file pays at least $690 a form for 2027 (IRC §6721(e)). For most 1099s the figure is the larger of that amount or 10% of the amounts that should have been reported, and there is no yearly cap. A $25,000 payment to one contractor, deliberately left off, is therefore $2,500, not $690. Forgetting, or not knowing a vendor needed a form, is not intentional disregard; ignoring a filing you knew was due can be.

Not sure which contractors you paid, or how much, because the books are behind?

That is a cleanup, not a one-off fix: $99 per month of backlog (20% off 6+ months), one fixed price agreed before any work starts. [Send the file for a free 48-hour review](/contact/?from=blog%2F1099-late-filing-penalty).

## Why a late 1099 is usually two penalties

There are two copies of every 1099, and each has its own penalty. Section 6721 covers the copy filed with the IRS. Section 6722 covers the copy owed to the contractor, called the payee statement, and the IRS says it applies “in the same manner” with the same amounts and caps (General Instructions, Part O; Rev. Proc. 2025-32, section 3.58). Most late 1099s are late on both sides, because whatever kept the form from going to the IRS also kept it from going to the contractor.

A worked example for 2026 payments, filed late on April 15, 2027:

| | Forms | Per form | Penalty |
| --- | --- | --- | --- |
| IRS copies, §6721 | 12 | $130 | $1,560 |
| Contractor copies, §6722 | 12 | $130 | $1,560 |
| **Total** | | | **$3,120** |

The same 12 forms filed by March 3 would have cost $1,440. Left until September, $8,160. Most of the cost is decided by how quickly the forms go out once the problem is found, which is why the answer to “should I still file?” is always yes.

## What counts as late, besides the date

Section 6721 is a penalty for failing to file a _correct_ return on time, so a form that went in on time can still be penalized. The General Instructions list what triggers it:

- **Filing late**, or not at all.
- **Missing or incorrect information**, including a missing or wrong taxpayer ID.
- **Filing on paper when you were required to e-file.** Anyone filing 10 or more information returns in a year, counting all form types together, must e-file (Treasury Decision 9972, effective for returns due on or after January 1, 2024). The General Instructions say this penalty applies only to the returns beyond 10.
- **Paper forms that cannot be machine read**, when they are required to be.

Two rules keep small mistakes from turning into penalties:

- **De minimis dollar errors.** A form that is off by no more than $100, or by no more than $25 of tax withheld, does not need correcting and is not treated as incorrect, unless the recipient asks for a corrected statement.
- **De minimis failures.** A form that was filed on time with missing or wrong information, and corrected by August 1, is not penalized for up to the greater of 10 forms or 0.5% of the forms you had to file. This does not help a form that was never filed on time.

An error in the taxpayer ID, the payee’s surname or any dollar amount is never “inconsequential,” so those always count. Fixing one is a corrected 1099, which has its own steps, set out in [how to correct a 1099](/blog/correct-a-1099/).

## Can you still file a 1099 after the deadline?

Yes, and you should. Each tier is cheaper than the next, and a form never filed costs the full $340 for each copy. File it the way you would have filed it on time, on the form for the year the payment was made, and send the contractor their copy at the same time. If you were required to e-file for that year, the late forms go in electronically as well.

An extension only helps if it is asked for before the due date, on Form 8809. For most 1099s it is an automatic 30 days. For the 1099-NEC and the W-2 it is not automatic: the IRS grants it only for the hardship reasons listed on the form, so planning to extend is not a way to buy time on contractor forms.

### Can I file a 1099 from 2 years ago?

Yes. There is no cutoff for filing a missed form. It falls in the after-August-1 tier, so it costs $340 a copy for forms due in 2026 or 2027 (older years used lower figures), and it is still cheaper than leaving it unfiled with the reason undocumented if the business is ever examined.

### Will the IRS catch a missing 1099?

A late or flawed form is caught automatically. Notice 972CG, Notice of Proposed Civil Penalty, is generated from the IRS payer records for filers who sent forms late, on paper when e-file was required, or with taxpayer IDs that do not match ([IRM 20.1.7.6](https://www.irs.gov/irm/part20/irm_20-001-007r)). A form never filed is not on those records, so there is nothing for that notice to match. It comes up when the IRS examines the business: the manual says field examiners impose the penalty during an examination when they find returns that were not filed or were filed late (IRM 20.1.7.3.2).

Not filing a 1099 does not by itself cost you the deduction for the payment. The deduction stands on the business records behind it (IRC §6001), which is a second reason to keep the invoice, the payment and the W-9 together.

## How to get a 1099 penalty reduced or removed

### Respond to the notice, not before

Notice 972CG proposes the penalty and lists the forms behind it. You can agree, or explain why some or all of it should not apply, by the response date on the notice. Check the counts first: notices are built from filed records, and a form the IRS shows as late may have been accepted on time under an extension or a waiver.

### Reasonable cause

IRC §6724(a) waives the penalty for a failure due to reasonable cause and not willful neglect. The General Instructions describe what that means: the failure came from events beyond your control or significant mitigating factors, and you acted responsibly before and after it. Treasury Regulation §301.6724-1 sets out the details, including the one most often available to small businesses: a missing or wrong taxpayer ID is excused when you made the required requests for it. Those requests, and the backup withholding that goes with them, are explained in [W-9 vs 1099](/blog/w9-vs-1099/).

### First Time Abate does not cover 1099s

The IRS administrative waiver for a first penalty covers failure to file, failure to pay and failure to deposit on tax returns. The Internal Revenue Manual lists “Form 1099 series information returns” among the returns where that waiver is “NOT applicable” ([IRM 20.1.1.3.3.2.1](https://www.irs.gov/irm/part20/irm_20-001-001r)). Several pages that rank for this question say a first-time 1099 penalty can be waived on request; under the manual, a late 1099 needs reasonable cause or one of the exceptions above.

## Recording the penalty in the books

The penalty is not deductible. IRC §162(f) disallows a deduction for amounts paid to a government “in relation to the violation of any law,” so it goes in its own expense account that the CPA can add back on the return, not in Taxes and Licenses or Professional Fees. Paying the $3,120 from the example:

| Account | Debit | Credit |
| --- | --- | --- |
| Penalties and fines | 3,120.00 | |
| Checking | | 3,120.00 |
| **Total** | **3,120.00** | **3,120.00** |

Penalties and fines is an Expenses or Other Expense account in QuickBooks Online, kept separate so its total is easy to find at year end.

## Where late 1099s come from in the books

The forms are late because the list behind them is late. These are the causes we see, in the order they usually turn up:

1. **No W-9 on file**, so nobody knows whether the vendor is a corporation or what number goes on the form.
2. **The vendor is not marked for 1099s in QuickBooks Online**, so it never shows up in the 1099 report.
3. **Payments recorded without a vendor**, as bank-feed transfers or checks coded straight to an expense account.
4. **The books are months behind**, so the payments are in the bank statement but not in the ledger.

The fixes, in the order to do them, are in [when to send a 1099](/blog/when-to-send-a-1099/). Whether a payment goes on the NEC or the MISC is in [1099-NEC vs 1099-MISC](/blog/1099-nec-vs-1099-misc/), and the other January and February deadlines are on the [business tax deadlines](/blog/business-tax-deadlines/) calendar.

## Common questions about 1099 penalties

### What is the penalty for a late 1099-MISC?

The same as for a 1099-NEC: $60, $130 or $340 a form for each copy, by when it is filed. Only the due date differs. For 2026 payments the 1099-MISC is due to the IRS March 1, 2027 on paper (February 28 is a Sunday) or March 31, 2027 electronically, and the recipient copy by February 1, 2027 ([Instructions for Forms 1099-MISC and 1099-NEC](https://www.irs.gov/instructions/i1099mec), Rev. December 2026). Count the tiers from the IRS due date for the §6721 penalty and from the recipient date for §6722.

### What is the $600 rule?

It was the 1099-NEC threshold until 2025. For payments made after December 31, 2025, the threshold is $2,000, and it may be adjusted for inflation from 2027 (Instructions for Forms 1099-MISC and 1099-NEC). A contractor paid $1,500 in 2026 does not need a 1099-NEC, so there is no penalty for not sending one. For 2027 payments the line is $2,100; the figures by year are in [the 1099 threshold for 2026 and 2027](/blog/1099-threshold/).

### Does every state charge its own penalty?

Many do, and the rules vary. A state that requires its own 1099 filing can charge for a late or missing state copy on top of the federal penalty. Check your state’s revenue department, or ask your preparer.

### Should the contractor amend their return if the 1099 arrives late?

Only if they left the income off. The contractor reports what they were paid whether or not a form arrived; the late form only gives them the payer’s figure to check against.

## When the 1099 list cannot be trusted

Every number above multiplies by the count of forms, and the count is only as good as the books under it. If contractor payments were coded without vendors, or months are still unentered, no report will produce a correct list, and corrected forms after a late filing double the work. Cleanup rebuilds the vendor records and the payments from the bank statements, so the forms are filed once and filed right.
