1099-NEC vs 1099-MISC: which form to file

· October 30, 2026

What is the difference between a 1099-NEC and a 1099-MISC?

Use Form 1099-NEC for $2,000 or more paid in 2026 to a nonemployee for services, due to the payee and the IRS by February 1, 2027. Use Form 1099-MISC for rent, prizes, medical payments and other non-service payments, plus royalties of $10 or more and settlement proceeds of $600 or more paid to an attorney.

1099-MISC vs 1099-NEC comes down to what the payment was for. If you paid a nonemployee to do work for the business, it goes on the 1099-NEC. Rent, royalties, prizes, medical payments and a short list of other payments go on the 1099-MISC. The forms also have different IRS deadlines, which is the reason there are two of them: the NEC is due earlier.

The one payee that confuses everyone is the attorney, who can land on either form depending on whether the money was a fee or a settlement passing through. The table below covers every common payment, and the sections after it take the attorney, the landlord and the QuickBooks setup one at a time. Every box, threshold and date is from the IRS instructions revised for payments made in 2026. Ledgerbrook keeps books and does not file returns, so take a payment you are unsure about to your CPA.

Source for every row: IRS Instructions for Forms 1099-MISC and 1099-NEC, Rev. December 2026. “Exempt” means payments to a corporation, including an LLC taxed as one, are generally not reported. The payee’s Form W-9 tells you which it is; what each box on the W-9 means is in W-9 vs 1099.

Reporting applies only to payments made in the course of a trade or business. Rent on your own apartment, or a lawyer for your divorce, never goes on either form.

Who should receive a 1099-NEC?

A nonemployee you paid $2,000 or more during 2026 for services to your business: an individual, a partnership, an estate, or in a few cases a corporation. The services test is the one that separates the forms. Since the IRS brought the NEC back for payments made in 2020, contractor pay has not gone on the 1099-MISC at all, so a contractor who receives a 1099-MISC for their work has been sent the wrong form.

Who counts as a contractor, which vendors are exempt, and how to build the list are owned by when to send a 1099, so this post does not repeat them.

What is 1099-MISC used for?

Business payments that are not for a nonemployee’s services. The 2026 form has these money boxes:

Box What goes in it
1 Rents: office space, machine rentals such as a bulldozer, pasture for grazing
2 Royalties, $10 or more
3 Other income: prizes and awards not for services, punitive damages, damages for nonphysical injuries, payments for taking part in medical research, a deceased employee’s wages paid to the estate
4 Federal income tax withheld, including backup withholding
5 Fishing boat proceeds paid to crew
6 Medical and health care payments to physicians and other providers
8 Substitute payments in lieu of dividends or interest
9 Crop insurance proceeds
10 Gross proceeds paid to an attorney
11 Cash paid for fish bought for resale
12 Section 409A deferrals of a nonemployee
15 Nonqualified deferred compensation of a nonemployee
13a, 13b, 14 Cash tips, tipped occupation code and overtime, included in box 3
16 to 18 State tax withheld and state information

Box 7 is a checkbox for direct sales of $5,000 or more. Payments to pharmacies for prescription drugs are left out of box 6.

Attorney fees: 1099-NEC or 1099-MISC?

Both, depending on what the money was for. The rule is in the IRS instructions, and the corporate exemption does not apply to either one: a law firm organized as a professional corporation still gets the form.

  • Fees for legal services to your business go on the 1099-NEC, box 1a, at $2,000 or more for 2026. Contract review, litigation defense, a collections attorney’s fee.
  • Gross proceeds paid to an attorney go on the 1099-MISC, box 10, at $600 or more. This is money that passes through the attorney’s hands, usually a settlement paid to the other side’s lawyer, where you cannot tell how much of it is the lawyer’s fee.

Two payments to two law firms, worked through

Northline Supply, a small distributor, made two payments to attorneys in 2026:

Payment Paid to Amount Form Box
Drafting supplier contracts Its own law firm, a professional corporation $4,500 1099-NEC 1a
Settling a customer’s damage claim, paid by check to the customer’s attorney The customer’s attorney $25,000 1099-MISC 10

The first is a fee for services to Northline, so the NEC. The second is gross proceeds: Northline paid the attorney, but most of the $25,000 belongs to the customer. Box 10 reports the full $25,000 to the attorney, whatever share the attorney keeps. Whether the customer should also get a form depends on what the settlement pays for, and that is a question for the CPA.

The $600 figure trips up search answers right now. The threshold for attorney fees rose to $2,000 with everything else in box 1a; only gross proceeds kept the old $600 floor.

Rent: when the landlord gets a 1099-MISC

Rent goes in box 1 of the 1099-MISC when the business paid $2,000 or more during 2026 to a landlord who is not a corporation. Real estate, equipment and machinery rentals all count. Four situations change that:

  • The landlord is a corporation, or an LLC that elected to be taxed as one: no form.
  • You pay a property manager or real estate agent, not the owner: no form from you. The IRS instructions put the reporting on the manager, who reports the rent it passes on to the owner.
  • You pay rent by credit card or a payment app: no form from you, because the processor reports it on Form 1099-K.
  • The rent is personal, such as the apartment you live in: no form, because it was not paid in the course of a business.

Ask a landlord for a W-9 when the lease is signed. A landlord who will not give a taxpayer ID is subject to 24% backup withholding on rent, the same as a contractor.

The 2027 deadlines for 2026 payments

Form Copy to the payee Filed with the IRS
1099-NEC Feb 1, 2027 Feb 1, 2027, paper or electronic
1099-MISC Feb 1, 2027 Mar 1, 2027 on paper; Mar 31, 2027 electronically
1099-MISC with an amount in box 8 or 10 Feb 16, 2027 Mar 1, 2027 on paper; Mar 31, 2027 electronically

The IRS dates are January 31, February 28 and March 31, each moved to the next business day when it lands on a weekend or legal holiday. In 2027, January 31 and February 28 are Sundays. The later payee date for boxes 8 and 10 is February 15, which in 2027 is Presidents’ Day, so it moves to Tuesday, February 16.

Two rules apply to both forms. A business filing 10 or more information returns of any kind for the year must file them electronically; the IRS’s free IRIS portal takes both forms. The NEC has no automatic extension: Form 8809 has to be filed by the due date, and the IRS grants NEC extensions only in limited cases (General Instructions for Certain Information Returns). The late-filing penalties are in when to send a 1099, and the rest of the filing season is on the business tax deadlines calendar.

What changed on both forms for 2026

The forms for 2026 payments, filed in early 2027, are the first under the One, Big, Beautiful Bill Act (P.L. 119-21). From the IRS instructions:

Change Detail
Threshold $600 to $2,000 for nonemployee compensation, rents, other income, medical payments and most other boxes, for payments made after December 31, 2025; may be indexed for inflation from 2027
Unchanged thresholds Royalties $10; gross proceeds to an attorney $600; cash fish purchases $600; direct sales $5,000
New boxes on the 1099-NEC 1b cash tips, 1c Treasury Tipped Occupation Code, 1d qualified overtime, all included in box 1a
New boxes on the 1099-MISC 13a cash tips, 13b tipped occupation code, 14 qualified overtime, included in box 3

The tip and overtime boxes exist so recipients can claim the new deductions on Schedule 1-A. For most small businesses paying contractors, nothing in them applies, and box 1a carries the total as before. If you are catching up on payments made in 2025, use the 2025 forms and the old $600 threshold. For 2027 payments the threshold rises to $2,100, and the full table by year is in the 1099 threshold for 2026 and 2027. The rest of the year-end work around the forms is in the year-end bookkeeping checklist.

What if I filed a 1099-MISC instead of a 1099-NEC?

Correct it, and it takes two filings. The IRS general instructions treat the wrong form type as a correction that needs two separate returns: a corrected 1099-MISC with the amounts zeroed out, and a new original 1099-NEC with the right figures. Send the contractor their copies of both, so their records match yours.

A wrong amount on the right form is simpler: one corrected form, with the CORRECTED box checked and the right number. Either way, file the correction as soon as you find the error, because the penalty is per return and grows with how late it is. The tiers and caps are in the 1099 late filing penalty, and the filing steps for each method are in how to correct a 1099.

How to map the accounts in QuickBooks Online

QuickBooks Online decides which form a payment goes on by the expense account it was recorded to, not by the vendor. When you prepare 1099s (All apps, then Expenses & Bills, then 1099s), the Select accounts step asks which accounts hold 1099 payments and which 1099-NEC or 1099-MISC box each one belongs in (Intuit: create and file 1099s with QuickBooks Online). The same accounts line up with the Schedule C lines in Schedule C expense categories.

QuickBooks account Detail type 1099 box
Contract labor Cost of labor 1099-NEC, box 1 nonemployee compensation
Legal & professional fees Legal & professional fees 1099-NEC, box 1 nonemployee compensation
Rent or lease Rent or lease of buildings 1099-MISC, box 1 rents
Equipment rental Equipment rental 1099-MISC, box 1 rents

Only contractors on the tracked list get a form, so an incorporated accounting firm paid from Legal & professional fees is not swept in. QuickBooks also leaves out payments recorded as credit card, debit card, PayPal or Venmo payments.

The failure we see most

One account holds two kinds of payment. A common version is an “Outside services” account used for both the subcontractors and the storage unit rent. Because the box follows the account, every payment in it lands in the same box: either the storage landlord gets a 1099-NEC for rent, or the subcontractors get 1099-MISCs for their labor. The fix is in the books, not the 1099 screen: recode the rent to Rent or lease and the labor to Contract labor, then prepare the forms. A vendor legitimately paid from both a rent account and a labor account gets both forms, which is correct.

Before filing, open the Reportable total for each contractor and use Preview to check the amount in each box against the vendor’s invoices.

Common questions about 1099-NEC and 1099-MISC

Do contractors get a 1099-MISC or a 1099-NEC?

A 1099-NEC, for payments for services. The 1099-MISC is for other kinds of payments, like rent.

Does a 1099-NEC mean I am self-employed?

Usually, but not always. The form’s recipient instructions say that if box 1a is self-employment income, a sole proprietor reports it on Schedule C or F and figures self-employment tax on Schedule SE; a partnership reports it on Form 1065. If it came from a sporadic activity or a hobby, it goes on the “Other income” line of Schedule 1. If you believe you were really an employee, you report it as wages and attach Form 8919 (Form 1099-NEC).

Do I have to report 1099-MISC on my tax return?

Yes. The amounts are taxable income, and the form’s recipient instructions say where each box goes: rents from real estate on Schedule E, box 3 on the “Other income” line of Schedule 1, and box 6 on Schedule C for individuals (Form 1099-MISC). Income is taxable whether or not a form arrives.

Can one vendor get both forms?

Yes. A landlord who also did repair work for you, paid $2,000 or more for each, gets a 1099-MISC for the rent and a 1099-NEC for the repairs, as long as the payments were coded to different accounts.

Is a 1099-NEC or a 1099-MISC due for a payment under $2,000?

Not for services, rent or other income paid in 2026. Royalties of $10 or more, gross proceeds to an attorney of $600 or more and cash fish purchases of $600 or more still are.

When the vendor categories cannot support the 1099s

The 1099 screen in QuickBooks only reads what the books already say. If a year of payments went to one catch-all account, or to Ask My Accountant, or to vendors set up under first names only, no mapping produces the right forms until those transactions are recoded. A cleanup moves each payment to the right account and vendor, so the NEC and MISC totals come out of the books instead of out of a spreadsheet built in late January.

$99per month of backlog20% off 6+ months

When to hand this off: if rent, contractor and legal payments share an account for more than a couple of months, or the books do not record which vendor each check went to, the 1099 totals cannot be checked against anything. A free file review looks at the accounts before anything is quoted, and QuickBooks cleanup has the full scope.
